1. Who We Are

Bluefox Technologies Limited operates the website www.bluefoxtechnologies.co.ke. We are responsible for deciding how your personal information is used in connection with our website and services. This policy explains what we collect, why we use it, who we share it with and your choices under Kenya's Data Protection Act, 2019.

Reading this policy or using our website does not, by itself, give consent to every use of your information. Where consent is required, it must be specific, informed and freely given.

2. Information We Collect

The information involved depends on how you use our services. It may include:

  • Contact and order details: Your name, email address, phone number, billing and delivery addresses, purchases and delivery instructions.
  • Identification and tax details: Identification information where needed for a specific service, and tax information you provide for invoicing.
  • Payment information: M-Pesa or card transaction information, payment references and billing details. The information involved also depends on the payment method and provider.
  • Support and preferences: Information you provide in enquiries, repair or warranty requests, and your marketing and communication preferences.
  • Website usage: IP address, browser or device information, pages visited and interactions collected through cookies and similar technologies.

Some details are necessary to process an order, arrange delivery or respond to a request. Without those details, we may be unable to provide the relevant service. Marketing consent is separate from the information needed to fulfil your order.

3. How We Collect Information

You provide information when you place an order, create an account, complete a form, subscribe to updates or contact us. Our website also collects information through cookies and similar technologies. Payment, delivery and other service providers may provide transaction or service updates needed to manage your order or request.

4. Why We Use It

  • Orders and services: To process purchases, payments, deliveries and related support, where needed to carry out our agreement with you or steps you request before buying.
  • Legal requirements: To meet tax, accounting and other applicable legal obligations.
  • Security and service improvement: To prevent fraud, protect our systems and improve services where we have a lawful legitimate interest that does not override your rights. Where a particular activity requires consent, that requirement still applies.
  • Marketing: To send promotions and product updates with your consent. See section 5 for how to stop these messages.

Different activities have different legal bases. We do not treat permission to process an order as permission to send marketing.

5. Marketing and Your Choices

You can withdraw marketing consent or ask us to stop direct marketing at any time. Use the unsubscribe option where provided in a message, or email it@hypermart.co.ke. You can also object to the use of your information for direct marketing, including related profiling.

Stopping marketing does not stop necessary communications about an existing order, payment, delivery or service request. Withdrawing consent does not affect the lawfulness of processing carried out before withdrawal.

6. Cookies, Analytics and Advertising

Cookies and similar technologies can support shopping functions, remember preferences, help us understand website use and support advertising or product recommendations. Website usage information can include pages viewed and interactions with page elements.

Our website includes third-party tools from Google, Meta, Microsoft Clarity, Mouseflow, Hotjar, Omnisend, Mailchimp, Recommend.pro and Cloudflare. These tools have different functions, including analytics, advertising, email marketing, recommendations and site monitoring. Some analytics tools support session replay, which can reproduce interactions with a page. The information collected depends on the tool and its configuration.

You can manage cookies through your browser settings. Blocking cookies may affect shopping or other website functions. Browser settings may not prevent every form of tracking. Contact our IT team if you need information about these tools or wish to raise a privacy concern. Where processing requires consent, browser use alone is not a substitute for it.

7. Sharing and Processing Outside Kenya

We may share information with providers that help us process payments, deliver orders, provide IT and hosting services, manage business records, support customers, send marketing or analyse website use. We may also disclose information where required by law or to handle legal claims. We do not sell or lease your personal information.

Some service providers may process information outside Kenya. Such transfers must meet applicable Kenyan data protection requirements, including a lawful transfer basis and the required safeguards. Contact our IT team for information about recipients, processing locations and safeguards relevant to your information.

8. Keeping Information Secure

We use technical and organisational measures to protect personal information against unauthorised access, disclosure or loss. Access is limited to employees and service providers with a business need to use it. No website or method of transmission is completely secure. If you suspect a privacy or security incident involving your information, contact our IT team.

9. How Long We Keep Information

We retain information for as long as needed for the purpose it was collected, including applicable legal, tax, accounting and reporting requirements. We consider the type and sensitivity of the information, the risk of harm, ongoing orders or service requests, and any legal claims or record-keeping duties.

Different records can have different retention periods. You can ask our IT team about the period or criteria that apply to your information. An erasure request may not remove records we must retain by law.

10. Your Rights and Complaints

Subject to the conditions and exceptions in Kenyan law, you can ask to:

  • Be informed about how your information is used and access a copy of it.
  • Correct inaccurate, incomplete or misleading information.
  • Erase information where the legal conditions for erasure apply.
  • Restrict or object to processing, including direct marketing.
  • Receive or transfer eligible information in a structured, commonly used format.
  • Withdraw consent where processing depends on it.

Email it@bluefox.co.ke with your request and enough information to identify the relevant account or transaction. We may need to verify your identity to protect your information. Please do not send passwords or full card details.

Requests are subject to the applicable statutory time limits. For example, access requests must be complied with within seven days, while erasure requests require a response within fourteen days. Access, correction, erasure, restriction and objection requests are free of charge; any permitted portability fee must be reasonable. You may also complain directly to Kenya's Office of the Data Protection Commissioner (ODPC). Visit the ODPC complaint page for instructions.

11. Third-Party Services and Children's Information

Links to other websites, including YouTube, take you to services with their own privacy policies. Embedded services and plug-ins may also collect information when used. This does not remove our responsibility for information we process or share.

If you believe a child has provided personal information to us, contact our IT team. Processing children's information requires the protections applicable under Kenyan law, including parental or guardian consent where required.

12. Changes to This Policy

We may update this policy as our services or legal requirements change. The latest version and its update date will appear on this page. Where appropriate, we will also notify you of material changes. Publishing an update does not itself create consent for a new use that requires it.
